Web Designer Terms & Conditions
PLEASE
READ THE FOLLOWING TERMS AND CONDITIONS. BY CLICKING ON THE "I AGREE"
BUTTON AT THE END OF THESE TERMS AND CONDITIONS, YOU AGREE (ON BEHALF OF
YOURSELF, INDIVIDUALLY, AND THE BUSINESS) TO BE BOUND BY THESE TERMS AND
CONDITIONS.
YOU MAY KEEP A COPY
OF THESE TERMS AND CONDITIONS.
We're sure that together, we can develop a
website that you'll be thrilled with. But,
if we are unable to meet your expectations with your preliminary input and
design criteria, you may cancel your project per the listed Project
Cancellation Terms listed below. Simply
let us know (IN WRITING).
The
following are cancellation policies of Buzz Web Designer as they apply to
various stages of the Web Site Design process. These policies deal specifically
with project cancellation and are part of our general terms and conditions. Should you have any questions about our terms
and conditions or our cancellation policies, please contact us.
STAGE 1
cancellation BEFORE presentation of preliminary designs.
If client wishes to cancel the Web Site Project BEFORE I start design on the
website for any reason, before approval and/or completion (Canceling must be in
writing by the client), there will be a $ 45 administration service fee charge.
This is to cover credit card processing fees and administration fees associated
with your project.
STAGE 2 cancellation AFTER
presentation of preliminary designs.
If the client wishes to cancel the Web Site Project AFTER I started working on the website and presented to you, prior to approval and/or completion. (Canceling must be in writing by the client), there will be a $70 administration service charge. This is to cover credit card processing fees, administration and any preliminary design work that may have been started on your project.
STAGE 3 cancellation AFTER your
website is COMPLETE.
If client wishes to cancel the Web Site project AFTER the project is COMPLETE
and presented to you, prior to your final approval, (canceling must be in
writing by the client) there will be a charge of 75% of the total amount of the
project. This is to cover credit card processing fees, administration and all
the design work that has done on your project. In the event of an ANY job or
project cancellation, any artwork created remains the exclusive intellectual
property and copyright of Buzz Web Designer.
Can
I make changes?
We are able to offer our templates at a very low cost based
on the assumption that modifications will be minimal. We can make any changes you request but we
cannot guarantee that there will not be a cost associated with it.
Please send us your final text. Time required to make extensive changes to the
client submitted text after the Web pages have been constructed will be
additional, billed at the hourly rate. Please let us know if there are changes
you would like to make to the page name, layout, etc. and we will do our best
to make these corrections.
Web Design Payment and Fees Terms
Fees to Buzz Web Designer are due and payable on the following schedule: 50%
upon signing this contract, 25% at stage 2 and the final 25% due upon
"delivery" (On receipt of all fees, your site content will be copied to your host
server). If the total amount of this contract is less than $200, the total
amount shall be paid upon signing this contract. All payments will be made in US funds. If the
client does not supply Buzz Web Designer complete text and graphics content all
Web pages contracted for within 60 days of the date this contract was signed,
the entire amount of the contract becomes due and payable. Payment in full is required upon
completion of services. Payment is also due in full upon completion of your
Website Updates and will not be uploaded to your website until payment has been
received.
How long does it take?
Buzz Web Designer and the client must work together to complete the Website in
a timely manner. We agree to work
expeditiously to complete the Website no later than 6 weeks after contract
acceptance. Once payment is received and
we have all of your material to complete the website pages (text, photos,
forms, etc.) we will start working on your website. To avoid additional
fees the client must supply Buzz Web Designer the complete text and graphics
content for the Website within 14 days.
Graphic Artist
You are responsible for paying for purchased graphics. I will purchase the
graphics for you and add them to your invoice.
All graphic artists’ terms of use will be strictly adhered to.
Updates/Maintenance
Monthly updates to your site for $25 (optional/only charge each month as needed
- you are entitled to 5 hours of maintenance per month). Monthly 5 hours may NOT be accumulated. Updates include: changes to the text on your
website as well as changes to keywords or meta tags to
improve Search Engine Optimization ONLY.
Payment is also due in full upon completion of your website
maintenance. Please submit all text
changes in an email message. Do not send
them as attachments.
Updates
NOT covered with Maintenance
The following is NOT included in the 5 hours monthly
updates: changes to graphics, layout or design, addition of photos or web
pages, and scanning of images or documents. These services are subject to
additional fees. Please
contact me for a quote for services that do not fall under Maintenance.
Payment
of fees
Payments must be made promptly. Delinquent bills will be assessed a $50 charge
if payment is not received within 30 days of the due date. If an amount remains
delinquent 45 days after its due date, an additional 5% penalty will be added
for each month of delinquency. Buzz Web Designer reserves the right to remove
Web pages from viewing on the Internet until final payment is made. In case
collection proves necessary, the client agrees to pay all fees incurred by that
process.
Copyrights
and Trademarks
The client represents to Buzz Web Designer and unconditionally guarantees that
any elements of text, graphics, photos, designs, trademarks, or other artwork
furnished to Buzz Web Designer for inclusion in Web pages are owned by the
client, or that the client has permission from the rightful owner to use each
of these elements, and will hold harmless, protect, and defend Buzz Web
Designer and its subcontractors from any claim or suit arising from the use of
such elements furnished by the client.
Laws
Affecting Electronic Commerce
From time to time governments enact laws and levy taxes and tariffs affecting
Internet electronic commerce. The client agrees that the client is solely
responsible for complying with such laws, taxes, and tariffs, and will hold
harmless, protect, and defend Buzz Web Designer and its subcontractors from any
claim, suit, penalty, tax, or tariff arising from the client's exercise of
Internet electronic commerce.
Sole Agreement.
The agreement contained in this "Web Page Design and Maintenance
Agreement" constitutes the sole agreement between Buzz Web Designer and
the client regarding this Website. Any additional work not specified in this
contract must be authorized by a written change order. All prices specified in
this contract will be honored for three (3) months after both parties sign this
contract. Continued services after that time will require a new agreement.
